FLIGHT DATA TERMS OF USE

Subscriber may not, nor may it permit others to:

1) Use Flight Data Data for air safety or air traffic control or in violation of any FAA regulations.

2) Allow Flight Data to be exported in violation of the export control laws or other laws of the

United States of America or any other country.

3) Subscriber must use the Flight Data in compliance with all requirements of law, including

any restrictions imposed by the FAA or any other governmental agency. The terms and

conditions for indirect subscribers set forth in the Federal Aviation Administration’s

Memorandum of Agreement for Industry Access to Aircraft Situation Display and National

Airspace System Status Information Data (MOA) date August 10, 2007.

4) Subscriber must use Flight Data in compliance with all requirements of law, including any

restrictions imposed by the FAA or any other governmental agency.
